Mediator Ethics in Practice

Introduction

Voluntariness is the ethical foundation of mediation and distinguishes it from adjudicative processes.

While mediators inevitably influence communication and negotiation dynamics, ethical practice requires that parties retain full control over whether and how they reach agreement.

This course examines how coercion and subtle pressure can arise during mediation, often unintentionally.

Participants will explore common risk points, recognize warning signs, and learn practical techniques for preserving party autonomy in high-pressure situations.
